Terms and conditions of the SMS/MMS mobile message marketing program

Camoli Distribution Inc. ("We", "Us", "Our") offers a mobile messaging program (the "Program") which you agree to participate in and use, subject to these Mobile Messaging Terms and Conditions (the "Agreement"). We may change or cancel the Program or any of its features without notice. This Agreement is limited to the Program and is not intended to modify any other terms and conditions or privacy policy that may govern the relationship between you and us in other contexts. We may also modify this Agreement at any time, and your continued use of the Program after the effective date of such modifications constitutes your acceptance of such changes.

The Program enables users to receive mobile SMS/MMS messages by subscribing to the Program, for example via online or application-based subscription forms. Your consent to receive automated marketing text messages is not required for the purchase of goods or services. Whichever method you choose to join the Program, you agree that this Agreement applies to your participation in the Program. If you have registered, the Program will send you updates, alerts, information, promotions, special offers and other marketing offers (for example, product discounts) from Camoli Distribution Inc. via text messages to your cell phone from the number you have provided. SMS/MMS mobile messages may be sent using an automated telephone dialing system or other technology. Message frequency may vary. You are responsible for any charges associated with text messages imposed by your wireless service provider. Messaging and data charges may apply.

If you do not wish to continue to participate in the Program or if you no longer accept this Agreement, you agree to respond STOP to any mobile message from us to unsubscribe from the Program. You may receive an additional mobile message confirming your decision to unsubscribe. You understand and agree that the foregoing options are the only reasonable methods of unsubscribing. You also understand and agree that any other method of unsubscribing, including, but not limited to, sending words other than those indicated above by SMS or verbally requesting one of our employees to remove you from our list, is not a reasonable method of unsubscribing.

If you have any questions, send the word "HELP" to the number from which you received the messages. You can also contact us for further information. If you wish to unsubscribe, please follow the procedures above.

We may change the telephone number we use to operate the Program at any time and will notify you of any such changes. You acknowledge that any message, including any STOP or HELP request, that you send to a telephone number that we have changed may not be received and we will not be responsible for honoring it.

Mobile operators supported by the Program are not responsible for delayed or undelivered messages. You agree to provide us with a valid cell phone number. You agree to provide us with accurate, complete and up-to-date information regarding your receipt of messages, including, but not limited to, notifying us immediately of any change in your cell phone number.

You agree to indemnify, defend and hold us harmless from and against any and all third party claims, liabilities, damages or costs arising from your use of the Program or the provision of a telephone number that does not belong to you. If at any time you are considering discontinuing use of the cell phone number used to enroll in the Program, including by cancelling your service plan or selling or transferring the phone number to another party, you agree to follow the unsubscribe process described above prior to discontinuing use of the cell phone number. You understand and agree that your agreement to do so is an integral part of these terms and conditions. You further agree that, if you change your telephone number without notifying us, you will be responsible for all costs (including attorney's fees) and liabilities incurred by us or any party involved in the delivery of SMS/MMS mobile messages, due to claims made by persons to whom such mobile telephone number was subsequently assigned. This obligation and agreement shall survive any cancellation or termination of your agreement to participate in any of our Programs.

You agree that we will not be liable for the non-delivery, delay or mis-delivery of any information sent through the Program, for errors in such information and/or for any action you may or may not take in reliance on the information or service.

You may not use or access the Platform if you are under the age of thirteen (13). If you use or access the Platform and are between thirteen (13) and eighteen (18) years of age, you must obtain permission from your parent or legal guardian to do so. By using or accessing the Platform, you acknowledge and agree that you are not under thirteen (13) years of age, are between thirteen (13) and eighteen (18) years of age and have the permission of your parent or legal guardian to use or access the Platform, or are of legal age in your jurisdiction. By using or accessing the Platform, you also acknowledge and agree that you are authorized by applicable law in your jurisdiction to use and/or access the Platform.

Overall, we undertake to comply with the Google Adwords Interest and Geographic Targeted Advertising Policy, the Restrictions on Sensitive Content Categories and the DoubleClick Services Platform Program Rules ).

Camoli Distribution obtains the consent of individuals to the collection, use and disclosure of any personal information about them, except as required by law.

We are committed to offering you the right to object to and withdraw your personal information.

The right of opposition is understood to be the possibility offered to Internet users to refuse that their personal information be used for certain purposes mentioned at the time of collection.

The right of withdrawal is understood to be the possibility offered to Internet users to request that their personal information no longer appear, for example, on a mailing list.
